The Federal High Court has affirmed the authority of the Federal Competition and Consumer Protection Commission (FCCPC) to investigate alleged exploitative pricing by MultiChoice Nigeria, the operators of DStv and GOtv.

The FCCPC has welcomed a recent Federal High Court ruling which upholds its right to investigate MultiChoice Nigeria Limited over its frequent price hikes on DStv and GOtv subscription plans.

The case, filed by MultiChoice, sought to restrain the Commission from probing the company’s pricing decisions. However, the court ruled in favor of the regulator, describing the suit as an abuse of court process.


A Victory for Regulatory Oversight — FCCPC

In a statement signed by Director of Corporate Affairs, Mr. Ondaje Ijagwu, the FCCPC’s Executive Vice Chairman, Mr. Tunji Bello, hailed the judgment as a “victory for the rule of law.”

“This ruling sends a strong signal that regulatory agencies cannot be hindered by procedural tactics when carrying out their lawful duties to protect consumers and **ensure market fairness,” Bello said.

He emphasized that the commission remains committed to investigating and addressing exploitative pricing practices under the FCCP Act of 2018.


Court Dismisses MultiChoice’s Suit

The ruling was delivered by Justice James Omotosho of the Federal High Court, who dismissed the case (FHC/ABJ/CS/379/2025). MultiChoice’s legal team, led by Moyosore Onigbanjo (SAN), had argued that the FCCPC continued sending threatening letters despite the pending court case.

Justice Omotosho, however, ruled that MultiChoice’s legal action was procedurally abusive and did not prevent the commission from carrying out its statutory mandate.


Why It Matters

The judgment comes at a time when many Nigerian consumers have expressed frustration over rising DStv and GOtv subscription costs, with some accusing the pay-TV giant of unjust pricing.

The court’s decision now clears the path for the FCCPC to fully investigate MultiChoice’s pricing structure and business practices—potentially leading to reform or sanctions if violations are confirmed.
